Responding to the Takings Challenge

This report helps planners and attorneys understand takings jurisprudence in light of the U.S. Supreme Court's 1987 trio of important land-use decisions. It summarizes and analyzes each of the cases and comments on its specific relevance to planners. The authors also pose a series of questions that can be used, in conjunction with real estate evaluaion techniques, to determine whether a taking has occurred. The report continues with two case studies that utilize the rulings and techniques discussed in the preceeding two sections. The report also explains why administrative hearings are an essential part of the zoning and land-use review process.
